Dispute resolution assistance for representative bodies

Representative Aboriginal/Torres Strait Islander bodies can request assistance from the NNTT in relation to their dispute resolution functions. Under s 203BK(3) of the Native Title Act 1993 (Cth), a representative body may obtain assistance from the NNTT if it is has entered into an agreement with the NNTT whereby it is liable to pay the Commonwealth for the assistance. Depending on the scope and nature of the assistance the Tribunal agrees to provide, payment may need only be on a cost recovery basis.

Assistance may include:

  • Alternative Dispute Resolution
  • Mediation process design
  • Meeting facilitation
  • Searches of the NNTT’s registers
  • Geospatial services including preparation of maps, analysis of tenures and spatial overlaps within identified areas
