On 17 December 2018, the State of Victoria lodged an
application for registration of the Taungurung Settlement ILUA as an Indigenous Land Use
Agreement.
On 30 April 2020, a delegate of the Native Title Registrar
registered the agreement and it was entered onto the Register
of Indigenous Land Use Agreements.
Following a judicial review of the delegate’s decision, on
19 March 2021 the Federal Court of Australia ordered that the agreement be
removed from the Register of Indigenous Land Use Agreements and the application
remitted to the Native Title Registrar, for consideration in accordance with
the law.
After considering the information which was before the
delegate and further information provided by the parties to the agreement, on
18 August 2021 the Native Title Registrar decided the agreement should not be
registered.
