Compensation Decision Gudanji Yanyuwa and Yanyuwa Marra Peoples v Northern Territory of Australia

In Davey on behalf of the Gudanji, Yanyuwa and Yanyuwa-Marra Peoples v Northern Territory of Australia (No 5) [2026] FCA 153, the Federal Court (Banks-Smith J) ordered the Northern Territory to pay compensation to the Gudanji Yanyuwa Garrwa Marra Aboriginal Corporation members (Claim Group). This is only the second case since Timber Creek in which a court has quantified native title compensation.

The case concerned whether a series of mining leases, approvals and validating legislation for the McArthur River Mine and associated infrastructure amounted to acts that qualify for compensation. Although these acts did not extinguish native title, the Claim Group argued that they significantly impaired their non-exclusive native title rights, causing both economic and cultural loss.

The Court found that the relevant acts constituted acquisitions of property otherwise than on just terms under the McArthur River Project Agreement Ratification Act 1992 (NT). Applying principles from the High Court's landmark Timber Creek decision, the Court assessed:

  • economic loss at approximately $743,000; and
  • cultural loss at $60 million, reflecting the profound and enduring impact on the Claim Group's connection to country.

After applying a 10% reduction to account for benefits received under an existing Indigenous Land Use Agreement (ILUA), total compensation was set at approximately $54.7 million.

Whilst there is no immediate impact on the NNTT's statutory functions, the decision confirms that large-scale resource projects can attract very substantial cultural loss compensation, reinforces the calculation methods used in Timber Creek for determining compensation awards, and clarifies how project-specific legislation and existing agreements, such as ILUAs, interact with compensation matters.​
