Provide your feedback: Native Title Acconsultation opens 

Public consultation is now open on evaluation of amendments to the Native Title Act 1993 made by the Native Title Legislation Amendment Act 2021. 

The Attorney-General's Department (AGD) is coordinating the review as required by s209A of the Native Title Act 1993. 

Feedback is particularly welcomed from: 

  • Aboriginal and Torres Strait Islander people who have interacted with the native title system including through Indigenous Land Use Agreements and members of a RNTBC, and 
  • legal practitioners, mediators and other professionals providing support services in the courts. 

​Feedback is sought on nine key areas subject of the 2021 amendments, including native title duties and decision-making; Indigenous Land Use Agreements; historical extinguishment; body corporate agreements; Registered Native Title Bodies Corporate (RNTBCs)and assistance in dispute resolution. 

The consultation will be used to identify any changes needed under the Native Title Legislation Amendment Act 2021. ​

A report of the evaluation, to be tabled in Parliament, is due 25 March 2026.

The AGD’s evaluation of the amendments made in 2021 is separate to the ongoing Australian Law Reform Commission review of the Future Acts Regime in the Native Title Act.
