Referral of claims for mediation
The Federal Court is responsible for the management of native title applications. The Court may refer matters to the NNTT, or an appropriate body or person for mediation.
The purpose of mediation is to assist parties to clarify the issues in dispute, to explore options for settlement and to reach agreement.
The NNTT may also provide mediation and agreement-making services not related to native title determination applications, such as assisting parties to negotiate stand alone ILUAs
and mediating agreements
about whether a future act affecting native title may be done.
