In the recent decision of the Full Court in Northern Land Council v Quall [2019] FCAFC 77 the Full Court of the Federal Court found that a representative body cannot delegate its certification function under s 203BE(1)(b) of the Native Title Act.
The Tribunal currently has a small number of Indigenous Land Use Agreements lodged for registration which may be impacted by the Quall decision. The Native Title Registrar is considering the complex legal and procedural issues arising from the decision.
