Latest edition of Native Title Hot Spots


The October 2011 edition of Native Title Hot Spots includes summaries of:

  • a Tribunal decision that four mining leases must not be granted because the native title party's interests, proposals, opinions or wishes in relation to the use of the area concerned should be given greater weight than the potential economic benefit or public interest in the mining project proceeding
  • the Full Federal Court’s decision confirming that a determination by the Tribunal that a future act may be done does not offend s 116 of the Constitution and that international instruments are only relevant where an ambiguity arises 
  • two decisions relating to whether those who constitute the applicant may act by majority vote and whether a native title claim group can put conditions on the authority it gives to the applicant 
  • a case where the Tribunal found it had no jurisdiction because the relevant s 29 notice was invalid 
  • several cases where the court decided not to exercise its discretion to join as respondents people with native title interests
