Widjabul People's native title application notified

The National Native Title Tribunal has placed advertisements in local newspapers indicating the start of a three-month notification period for a native title application around the Lismore region in northern NSW. The advertisement notifies people with an interest that may be affected by the claim to apply to become a party so that they can be included in negotiations.

The Tribunal's NSW State Manager Ms Rowena Finnane said the native title applicants, the Widjabul People, have applied for recognition of native title over an area extending from Nightcap National Park in the north and almost to Coraki in the south and from east of Kyogle towards Bangalow.

She said it was important for the community to understand that most of the land within that external boundary was not included. For example, the application for native title excluded private freehold land, most types of leases and other areas where native title had been extinguished, such as roads and other public works.

'Existing valid leases, licences and permits will continue to operate,' Ms Finnane said. 'The community's rights of public access to public areas such as national parks, waterways and stock-routes are also guaranteed under the law.

'People or organisations with interests in the areas claimed may want to be involved in working out how their rights may coexist with native title.

'By applying to become a party, people may have the opportunity to participate in mediation meetings with the applicants and other parties. The Tribunal conducts these meetings, aiming to resolve associated issues and reach voluntary agreements that respect everyone's rights and interests.'

The Widjabul People's application falls within the local government areas of Ballina, Byron and Tweed Shire Councils, Richmond Valley Council, Kyogle Council and Lismore City Council.
