The registration process

To have an agreement registered on the register of Indigenous Land Use Agreements, apply in writing to the Native Title Registrar using the application forms under the related resources box on this page.

The Registrar checks the application and agreement to ensure they meet the requirements of the Native Title Act 1993 (Cwlth). Information is available to help applicants meet the requirements for registration:

If an application and agreement meet the Act's requirements, the Registrar will notify the necessary people and organisations of the application to register the ILUA. During the notice period, certain people can object or express concerns about the registration of the agreement on certain grounds. An ILUA registration decisions can only be made after the Registrar's delegate has given due consideration to any valid objections or other material lodged.

Lodgement 

Any party, with the consent of other parties, can lodge an application to register the ILUA with the Native Title Registrar. To minimise delays, it is a good idea to get assistance from the Tribunal, for example, getting feedback on the draft ILUA before lodging it for registration.
