The Tribunal produces guidelines and procedures for applications and determinations that set out administrative arrangements for the implementation of the Native Title Act 1993 (Cwlth).

Registration testing of native title determination applications - claimant applications
 
The Tribunal has produced a guide for Indigenous Australians seeking information on the registration test. The registration test is a set of conditions applied to a native title determination application - claimant application. This guide should be read in conjunction with the Full Federal Court’s decision in Gudjala People # 2 v Native Title Registrar [2008] FCAFC 157. This decision provides clarification about the factual basis claim groups need to provide at Schedule F of the application in support of their claimed native title rights and interests. Mediation guidelines

National Case Flow Management Scheme

As part of its response to the Claims Resolution Review in 2006, the Tribunal introduced the National Case Flow Management Scheme (the NCFMS) in April 2007. The scheme has a strong regional focus and introduces some new components to the administration of our mediation practice.

Procedural directions

Amendments made in 2007 and 2009 to the Native Title Act 1993 (Cwlth) changed the Tribunal's  powers to perform its functions. To facilitate this, the Tribunal President issued a series of procedural directions.

Some directions refer to other documents relevant to complying with one or more direction.

The directions may be amended from time-to-time in light of experience or as external circumstances change. Additional directions may be made on other topics as the need arises.

Guidelines issued by other organisations

Guidelines issued by the Attorney-General on 1 January 2008, in accordance with Section 183 of the Native Title Act, provide for the provision of financial assistance to parties in relation to an inquiry, mediation or native title proceeding.
